These Terms and Conditions set out the basis on which House Clearance Barnet provides house clearance and waste collection services. By booking a service with us, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.
In these Terms and Conditions, the following expressions have the meanings given below:
Customer means the person, firm or company requesting services from House Clearance Barnet.
Services means house clearance, waste collection, removal, transport and related services provided by House Clearance Barnet.
Waste means any items, materials, furniture, appliances, household goods, garden waste or other goods to be removed or disposed of by House Clearance Barnet as part of the Services.
Contract means the agreement between the Customer and House Clearance Barnet made up of these Terms and Conditions and the booking confirmation.
House Clearance Barnet provides domestic and commercial house clearance and waste collection services. The scope of each job will be as described in the quotation and booking confirmation. It is the Customer's responsibility to check that the description of the Services meets their requirements before confirming a booking.
Services typically include collection, loading, transport and lawful disposal or recycling of Waste. Additional tasks such as basic sweep-up, separation of recyclables and removal from specific rooms or external areas may be included, subject to prior agreement. Any services that fall outside the agreed scope may incur additional charges.
3.1 Initial enquiry
Customers may request a quotation by telephone, email or online enquiry. To provide a quotation, we may ask for information about the property, access, the type and approximate volume or weight of Waste and any special requirements. We may request photographs or, for larger or complex clearances, arrange a site visit.
3.2 Quotations
Quotations are based on the information provided by the Customer at the time of enquiry. They are usually given as a fixed price or as an estimate subject to confirmation on arrival. Where a quotation is provided as an estimate, the final price may be adjusted to reflect the actual volume, weight or nature of the Waste, access conditions or any additional work required.
3.3 Acceptance and booking confirmation
A Contract is formed when the Customer accepts a quotation and a booking is confirmed by House Clearance Barnet via email, text message or other written confirmation. The booking confirmation will normally state the service address, date and approximate arrival time window, and the agreed pricing basis.
3.4 Customer obligations at booking
The Customer must ensure that all information provided during the booking process is accurate and complete. This includes full address details, contact information, access arrangements, parking availability and any known restrictions or hazards. The Customer must inform us of any items that require special handling, such as heavy equipment, hazardous materials or items located in lofts or confined spaces.
The Customer is responsible for ensuring safe and reasonable access to the property and to the Waste on the scheduled service date. This includes making sure that keys or access codes are available if required and that any entry arrangements have been agreed in advance.
The Customer must arrange suitable parking or provide information about local parking restrictions, permits or loading bays. Any parking charges, fines or penalties incurred as a direct result of the Customer failing to provide correct information or necessary permits may be added to the final invoice.
If our team is unable to carry out the Services due to lack of access, unsafe conditions or failure by the Customer to comply with these Terms and Conditions, we may charge a call-out or cancellation fee as described in the cancellations section.
5.1 Acceptable waste
We can remove most types of non-hazardous household and commercial waste including furniture, appliances, general rubbish, garden waste, bric-a-brac, clothing and similar items. All Waste must be capable of being safely collected and loaded by our team.
5.2 Restricted and hazardous materials
Certain materials cannot be collected or require special arrangements under UK waste regulations. These may include, but are not limited to, asbestos, clinical or medical waste, biological waste, chemical waste, oil, fuel, gas cylinders, explosives, radioactive materials, paint in liquid form, solvents and other substances classified as hazardous.
The Customer must notify us in advance if any such items are present. We reserve the right to refuse to collect restricted or hazardous materials or to arrange a specialist disposal service at additional cost, which will be confirmed and agreed before proceeding.
5.3 Electrical and electronic equipment
We will handle waste electrical and electronic equipment in accordance with applicable regulations. Where possible, these items will be taken to appropriate reuse or recycling facilities.
The Customer must ensure that:
The Waste to be removed is clearly identified or separated from items that are to be retained.
No valuable items, important documents or personal possessions that the Customer wishes to keep are left within the Waste to be collected.
Any required permissions from landlords, property managers or other third parties are obtained before the scheduled service.
The property is in a safe condition for our team to work, including structurally safe floors, staircases and access points.
Where relevant, utility services have been safely disconnected from large appliances or fixtures that are to be removed, unless otherwise agreed.
House Clearance Barnet will not be liable for items taken in error if they were not clearly separated or identified as items to be retained.
7.1 Pricing basis
Prices are usually calculated based on a combination of the volume and type of Waste, labour required, access conditions, distance, disposal costs and any specialist handling required. All prices quoted are exclusive of any parking charges, congestion or clean air zone charges, unless otherwise stated.
7.2 Payment methods
Payment is due on completion of the Services, unless alternative arrangements are agreed in writing before the service date. We accept common payment methods such as cash, bank transfer or card payment, subject to availability at the time of service.
For commercial Customers or larger projects, we may require a deposit or full payment in advance. Any such requirement will be clearly communicated in the booking confirmation.
7.3 Overruns and additional charges
If, upon arrival, the volume of Waste is significantly greater than described at the time of quotation or if additional work is requested, we may revise the price accordingly. Any changes will be discussed with the Customer before proceeding. Where the Customer declines revised pricing, a call-out fee may apply.
7.4 Late payment
Where payment terms allow for payment after completion, any invoices not paid by the due date may incur interest and reasonable recovery costs in accordance with applicable UK legislation.
8.1 Customer cancellations
The Customer may cancel or reschedule a booking by giving us reasonable notice. We ask that at least 24 hours notice is provided wherever possible. Cancellations made with less than 24 hours notice may incur a cancellation fee reflecting the costs and time reserved for the booking.
Where a deposit has been paid and the Customer cancels with insufficient notice, we may retain part or all of the deposit to cover costs already incurred, including staff allocation and administration.
8.2 Our right to cancel or reschedule
We reserve the right to cancel or reschedule a booking where events beyond our reasonable control prevent us from delivering the Services. These may include severe weather, vehicle breakdown, illness, accidents, road closures or other unforeseen circumstances. In such cases we will aim to notify the Customer as soon as reasonably practicable and to arrange an alternative date and time. We will not be liable for any indirect losses or consequential costs arising from such cancellations.
8.3 Waiting time and abortive visits
Where our team arrives within the agreed time window but is unable to start work due to lack of access, incomplete preparation, unsafe conditions or other issues within the Customer's control, we may charge for waiting time or treat the visit as abortive. In such cases, a call-out or cancellation fee may apply.
Our team will carry out the Services with reasonable care and skill and in accordance with relevant UK waste and environmental regulations. We will make reasonable efforts to arrive within the agreed arrival window, but this is not guaranteed and is subject to traffic, road conditions and other operational factors.
Upon completion of the clearance, we may invite the Customer or their representative to inspect the area cleared. Any concerns must be raised immediately before our team leaves the site so that they can be addressed where feasible.
House Clearance Barnet operates in accordance with applicable UK waste regulations and holds or operates under any necessary licences or registrations required for the collection and transport of controlled waste.
Waste collected through our Services will be taken only to authorised facilities such as recycling centres, transfer stations or licensed disposal sites. We aim to minimise the amount of waste sent to landfill by prioritising reuse and recycling where possible and practicable.
The Customer confirms that they have the authority to transfer the Waste to House Clearance Barnet and that the Waste does not contain any prohibited or undisclosed hazardous materials. We may refuse to collect or may separately charge for any Waste that breaches these requirements.
11.1 Damage to property
We will take reasonable care when carrying out the Services. However, the Customer acknowledges that the process of removing bulky items, navigating tight spaces or dealing with heavy Waste can involve risk of minor damage. Where the Customer is concerned about delicate surfaces, fixtures or fittings, they must inform us before work begins so that additional precautions can be taken.
We will not be liable for pre-existing damage, fair wear and tear, or unavoidable minor scuffs or marks that may occur when removing large or heavy items through confined spaces. Any claim for damage must be notified to us in writing as soon as reasonably practicable and in any event within 7 days of the service date, including reasonable evidence of the alleged damage.
11.2 Exclusions of liability
To the fullest extent permitted by law, we will not be liable for loss of profits, loss of business, loss of opportunity, indirect or consequential loss or any loss arising from information provided inaccurately by the Customer.
Nothing in these Terms and Conditions excludes or limits liability for death or personal injury caused by our negligence or for any other liability that cannot be excluded under UK law.
House Clearance Barnet maintains insurance policies appropriate to the nature of its business, which may include public liability insurance. Details of insurance cover are available on request. The existence of insurance does not extend or increase our liability beyond that set out in these Terms and Conditions.
By allowing us to remove Waste from the property, the Customer warrants that they are the legal owner of the items or have obtained the necessary permission from the owner to dispose of them. The Customer agrees to indemnify House Clearance Barnet against any claims from third parties alleging that the disposal of items was unauthorised.
Title to the Waste passes to House Clearance Barnet at the point of collection, subject to compliance with all relevant laws and regulations. Once removed, we may dispose of or divert the Waste for reuse or recycling at our discretion, except where specific arrangements have been agreed in advance.
If the Customer is dissatisfied with any aspect of the Services, they should contact us promptly with details of the issue. We will investigate the matter and aim to respond within a reasonable time frame. Where appropriate, we may offer to rectify the issue or provide another suitable remedy in line with our obligations under UK consumer law.
If a dispute cannot be resolved directly, the parties may consider independent mediation or other forms of alternative dispute resolution before pursuing formal legal proceedings.
We will handle personal information provided by the Customer in accordance with applicable data protection laws in the UK. Personal data collected for the purposes of providing the Services will be used only as necessary to process bookings, perform the Services, manage payments, handle queries or comply with legal obligations. We take reasonable steps to safeguard personal information and will not sell it to third parties.
House Clearance Barnet may update or amend these Terms and Conditions from time to time. The version in force at the time of booking will apply to the Contract with the Customer. A copy of the current Terms and Conditions is available on request.
These Terms and Conditions and any Contract between House Clearance Barnet and the Customer are governed by and interpreted in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.
If any provision of these Terms and Conditions is held to be invalid or unenforceable by a court or other competent authority, such provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions shall continue in full force and effect.
No failure or delay by House Clearance Barnet to exercise any right or remedy under these Terms and Conditions shall constitute a waiver of that or any other right or remedy.
The Customer may not assign or transfer their rights or obligations under the Contract without our prior written consent. We may assign or subcontract our rights and obligations where necessary to deliver the Services, provided that this does not reduce the level of service or protection afforded to the Customer under these Terms and Conditions.
